Note on the relationship between these Terms and individual contracts: These General Terms and Conditions (GTC) apply in addition to the individual riding-share and horse boarding agreements. Deviating provisions in an individual contract take precedence over these GTC, provided they do not place the customer in a worse position than the statutory minimum standard or than these GTC (Section 305b of the German Civil Code, BGB). Provisions to the customer's detriment that deviate from mandatory statutory protective provisions remain ineffective, even if agreed individually by contract.

Part A – General Provisions

Section 1 Scope of Application and Contracting Parties

1.1 These General Terms and Conditions ("GTC") apply to all contracts for riding shares, horse boarding (livery), and the use of the arena and hall facilities of the MainEquine riding facility between ROWA GmbH & Co. KG (hereinafter "MainEquine") and its customers.

1.2 For the purposes of these GTC, "customers" include both consumers (Section 13 BGB) and businesses/entrepreneurs (Section 14 BGB). Where a clause expressly limits its application to one of these groups, it applies only to that group.

1.3 The contracting party is ROWA GmbH & Co. KG, registered office In der Stelzbach 1, 65618 Selters ("MainEquine" or the "Riding Facility"). The riding facility itself is operated at Hahnstraße 87, 60528 Frankfurt am Main; all services (riding share, boarding, use of arena and hall) take place there.

1.4 Deviating, conflicting, or supplementary terms and conditions of the customer do not become part of the contract unless MainEquine expressly agrees to their application in writing.

Section 2 Conclusion of Contract and Booking Platform

2.1 The riding-share or boarding contract is concluded upon written confirmation of a booking by MainEquine, or upon the customer's acceptance of an offer expressly designated as binding by MainEquine.

2.2 MainEquine is entitled to accept the customer's contractual offer within 7 days of its receipt.

2.3 Confirmed bookings and reservations are binding on both parties.

2.4 Training and riding times are booked via the external booking platform "REITBUCH." MainEquine assumes no liability for the content, availability, or functionality of this platform, or for the content of linked third-party websites, to the extent MainEquine has no influence over them. Technical malfunctions of the platform do not release the customer from the obligation to pay for services already rendered or contractually owed; conversely, in the event of a platform-related outage, MainEquine must offer reasonable alternative solutions for scheduling appointments.

Section 3 Prices, Payment, and Default

3.1 Agreed prices include the applicable statutory value-added tax.

3.2 The monthly flat fee covers the following services:

  • For riding shares: the right to ride within the agreed scope, basic care of the horse, feed, stable rent, routine hoof care, standard veterinary services, and insurance within the contractually agreed scope.

  • For boarders: stable space rental, bedding, feed, standard grooming services, pasture access, paddock use.

The flat fee is a monthly payment for the services listed and not an hourly fee for use of the horse.

3.3 Outstanding amounts become due on the agreed due date; MainEquine may demand immediate payment once due.

3.4 If the customer defaults on payment, MainEquine is entitled to charge default interest at a rate of 5 percentage points above the respective base rate of the German Federal Bank (Deutsche Bundesbank). The right to assert proven higher damages caused by the default remains reserved; the customer remains free to prove that lower or no damage occurred.

3.5 The customer may only set off against claims of MainEquine, or exercise a right of retention, if the customer's counterclaim is undisputed or has been finally and bindingly established by a court, or if it arises from the same contractual relationship.

3.6 The place of performance for the riding facility's services is its location at Hahnstraße 87, 60528 Frankfurt am Main. The place of payment is MainEquine's registered office, In der Stelzbach 1, 65618 Selters.

Section 4 Third-Party Services

4.1 MainEquine may put the customer in contact with third-party providers (e.g., farrier, veterinarian, physiotherapist). Such third-party services are provided exclusively by the respective third party under its own responsibility and for its own account; a separate contract is formed directly between the customer and the third party.

4.2 MainEquine is not liable for the proper performance of third-party services, unless MainEquine selected a third party who was recognizably unsuitable or breached its own duties of review and care when arranging the introduction.

Part B – Use of the Facility, Safety, and Animal Welfare

Section 5 Hours of Use and Access

5.1 The riding facility may be used Monday to Friday from 6:00 a.m. to 9:00 p.m., and Saturdays, Sundays, and public holidays from 7:00 a.m. to 6:00 p.m. Training and riding appointments must be booked bindingly via REITBUCH and must fall within these hours. Specific riding times and frequency are set out in the individual contract.

5.2 Access to the facility is permitted only within the hours of use set out in paragraph 5.1; exceptions require prior agreement with MainEquine.

Section 6 Protective Equipment and the Rider's Personal Responsibility

6.1 Riding is a sport involving animal-related risks, including falls, unexpected movements, kicks, or the horse shying. The customer has been informed of this.

6.2 Every rider must wear, at minimum, while using the facility and the horses:

  • a riding helmet compliant with EN 1384 in its current applicable version,

  • suitable footwear or riding boots,

  • riding attire appropriate to the discipline, as well as any additional protective equipment where applicable (e.g., body protectors for show jumping).

6.3 MainEquine does not provide personal protective equipment. MainEquine is not liable for injuries resulting from the absence or inadequacy of personal protective equipment, provided MainEquine was not itself obligated to supply it and provided the limitation of liability under Section 12 effectively applies. MainEquine's independent liability as keeper or supervisor of the animals under Sections 833, 834 BGB remains unaffected by this provision (see Section 12.3).

6.4 By entering into the contract, every customer, rider, and boarder confirms that they hold valid liability insurance covering damage arising from the use of the horses as well as damage to third parties and their property, meeting the minimum coverage amount specified in Section 12.9. MainEquine may request proof of insurance at any time; without valid proof, MainEquine may refuse use of the facility and the horses.

6.5 The rider undertakes not to ride under the influence of alcohol or other substances impairing fitness to ride, and not to work horses beyond their capacity or train them improperly. Violations are subject to Section 16 (Breach of Contract and Termination).

Section 7 Health Requirements for Boarded Horses

7.1 The boarder warrants that, at the time of admission, their horse is free of contagious diseases, does not come from a herd currently affected by acute illness, and has the current vaccinations required under the individual contract (including, among others, tetanus, influenza, and herpes).

7.2 Infectious diseases, parasite infestation, injuries, lameness, or noticeable behavioral changes must be reported to MainEquine without delay and in text form (e.g., e-mail).

7.3 MainEquine is entitled to temporarily isolate a horse that is visibly ill or suspected of being contagious, in order to protect the other horses and persons. Complete exclusion from the facility may only be considered after prior notice and with due regard to proportionality, except in cases of acute danger to other animals or persons.

7.4 Costs for farrier services, dental treatment, veterinary services, medication, emergency treatment, horse insurance, and special or supplementary feed are borne by the boarder in addition to the monthly flat fee, unless otherwise agreed in the individual contract.

Section 8 Animal Welfare

8.1 The welfare of the horses is MainEquine's top priority. MainEquine will take action where there are indications of violations of the Animal Welfare Act or of the facility's animal welfare guidelines.

8.2 Animal welfare violations include, in particular, overexertion or professionally incorrect training, neglect or inadequate care, violence or mistreatment, and insufficient hygiene or feeding. Serious violations, or violations repeated despite a warning, entitle MainEquine to extraordinary termination under Section 16.2.

Part C – Service-Specific Provisions

Section 9 Riding Shares

9.1 Scope of use. Riding-share participants may ride their assigned horse only during the times booked under the contract and confirmed via REITBUCH. The horse may not be taken off the premises during the booked time; off-site rides are permitted only where expressly agreed in the individual contract. After the booked time ends, the horse must be returned promptly and in proper condition to its stall.

9.2 Consequences of violations. If the riding-share participant violates paragraph 9.1, MainEquine may, on a case-by-case basis and taking into account the severity of the violation, issue a warning, suspend the riding share for a reasonable period, or — in the case of repeated or particularly serious violations, especially where the horse is endangered — terminate the contract for cause (Section 15.2). Automatic exclusion from the facility for every violation, including minor ones, is excluded; any measure taken must be proportionate in the individual case.

9.3 Duty to report injuries. Injuries to the horse occurring during use by the riding-share participant must be reported to MainEquine without delay, and no later than within 24 hours, in text form. The report should include the date, time, course of events, nature and location of the injury, and any witnesses. A culpably omitted or delayed report may be treated as a breach of contract and entitles MainEquine to the measures set out in paragraph 9.2.

Section 10 Horse Boarding (Livery)

10.1 Stable work. Where agreed in the individual boarding contract, the boarder may undertake certain stable and care tasks (e.g., mucking out, feeding) on their own responsibility. Scope and timing are governed by the individual contract.

10.2 Use of facility amenities. The solarium, paddocks, riding arenas, and comparable facilities may be used by the boarder within the agreed scope. MainEquine's liability for damage arising from such use is governed by Section 12; this does not affect liability for the mere realization of the general risk inherent in animals. Separate usage fees are governed by the individual boarding contract.

Part D – Liability, Recordings, and Vehicle Parking

Section 11 Photos, Videos, and Publication Rights

11.1 MainEquine is entitled, in the course of operating the facility, to take photos and videos of riders and horses and to publish them on its own social media channels and in marketing materials. The processing of personal data in connection with such recordings is governed by the separate privacy policy; the data-protection consent is regulated there and is not replaced by these GTC.

11.2 MainEquine will link names or other personal details (e.g., address, date of birth) to image material only with separate consent, and will publish recordings of children only with the consent of their parents or legal guardians.

11.3 The customer may object at any time, informally and with effect for the future, to the use of individual recordings; material already published will be removed promptly upon a justified request, to the extent technically and legally possible.

Section 12 Liability

12.1 Principle. MainEquine is liable for damages in accordance with statutory provisions, except as otherwise set out in the following paragraphs.

12.2 Limitation in case of slight negligence. In the event of a slightly negligent breach of duty, MainEquine is liable only for damages resulting from the breach of a material contractual obligation (cardinal obligation) — i.e., an obligation whose fulfillment is essential to the proper performance of the contract in the first place and on whose observance the customer may regularly rely. In such cases, liability is limited to the foreseeable damage typical for this type of contract.

12.3 No limitation for keeper's liability, personal injury, intent, and gross negligence. The limitations under paragraph 12.2 do not apply to:

  • MainEquine's strict (no-fault) liability as keeper or supervisor of the horses under Sections 833, 834 BGB for damage caused by the horses — this liability exists irrespective of fault and is neither excluded nor limited by these GTC;

  • damage resulting from injury to life, body, or health caused by a negligent, grossly negligent, or intentional breach of duty by MainEquine, its legal representatives, or vicarious agents;

  • damage resulting from an intentional or grossly negligent breach of duty by MainEquine, its legal representatives, or vicarious agents;

  • claims under the German Product Liability Act.

12.4 Rider's personal responsibility. Notwithstanding paragraphs 12.1 to 12.3, the rider remains personally responsible for their own riding conduct, the choice of appropriate protective equipment, their physical fitness, and compliance with safety rules. This personal responsibility concerns the general risk inherent in equestrian sport and does not release MainEquine from keeper's liability under paragraph 12.3 or from liability for its own fault.

12.5 Scope of liability regarding third parties. To the extent MainEquine's liability is excluded or limited under the preceding paragraphs, this also applies for the benefit of MainEquine's legal representatives, employees, and vicarious agents.

12.6 Third-party services. MainEquine is not liable for the quality or performance of third-party services it has arranged (Section 4); claims must be asserted against the respective service provider. MainEquine's liability for fault in selecting or arranging such third parties remains unaffected.

12.7 Limitation period. The statutory limitation period of three years applies (Section 195 BGB). These GTC do not provide for any shortening of statutory limitation periods; this also applies to claims arising from culpa in contrahendo, positive breach of contract, and tort.

12.8 Parked vehicles. Where MainEquine provides the customer with a parking area for motor vehicles, no supervision is provided, and no bailment (safekeeping) contract is formed. MainEquine is liable for loss of or damage to parked vehicles and their contents only in cases of intent or gross negligence on the part of MainEquine or its vicarious agents.

12.9 Minimum coverage amount of customer insurance. The customer's liability insurance, to be evidenced under Section 6.4, must provide minimum coverage of €5,000,000 per claim event. MainEquine may request proof of this minimum coverage at any time; without sufficient proof, use of the facility and the horses may be refused. MainEquine's statutory liability under paragraphs 12.1 to 12.3 remains unaffected by this and exists independently of whether, or to what extent, MainEquine itself holds insurance.

Part E – Termination of Contract

Section 13 Price Adjustment

13.1 MainEquine may adjust the monthly flat fees and other prices. Price increases will be communicated to the customer in text form at least 4 weeks before they take effect.

13.2 The customer may terminate the contract for cause effective as of the date a price increase takes effect. Notice of termination must be received before the increase takes effect.

Section 14 Amendment of These GTC

14.1 Material changes. Amendments to these GTC concerning the type, scope, or price of the main services, MainEquine's liability, the termination provisions, or other material rights and obligations of the customer become effective only if the customer expressly consents to them (e.g., by signing an addendum or by active confirmation in text form). If no consent is given, the previous GTC continue to apply.

14.2 Non-material adjustments. For adjustments that are purely editorial in nature, serve clarification purposes, or result from mandatory statutory changes, changes in supreme court case law, or regulatory requirements, without worsening the customer's legal position, notice in text form with at least 6 weeks' notice before taking effect is sufficient. In the notice, MainEquine will expressly point out the specific change and the customer's right to object to it in text form within this period. If the customer objects, the affected provision continues to apply in its previous version.

14.3 With every notice of amendment, MainEquine will expressly state whether it concerns a material change under paragraph 14.1 or an adjustment under paragraph 14.2.

Section 15 Termination

15.1 Ordinary termination. Unless otherwise agreed in the individual contract, either party may terminate the contract in text form with 30 days' notice to the end of a calendar month.

15.2 Extraordinary termination by MainEquine. MainEquine may terminate the contract for cause, in text form and with immediate effect, in particular if:

  • the customer grossly violates, or repeatedly violates despite a warning, these GTC or the individual contract;

  • the customer commits or tolerates animal welfare violations within the meaning of Section 8.2;

  • the customer intentionally or through gross negligence damages or substantially endangers the facility;

  • the customer remains in default despite a reminder setting a deadline of at least 14 days;

  • the customer fails to provide valid proof of the required liability insurance;

  • the customer significantly harasses, threatens, or physically attacks other users, staff, or trainers;

  • the customer seriously or repeatedly violates the usage rules for riding shares under Section 9.1.

15.3 Right to exclude from premises. In particularly serious cases (e.g., violence, significant endangerment of persons or animals, animal abuse), MainEquine may exercise its right as property owner/occupier to issue a ban from entering the premises; this constitutes an individual-case measure and does not replace the grounds for termination under paragraph 15.2.

15.4 Extraordinary termination by the customer. The customer may terminate the contract for cause if MainEquine fails to fulfill material contractual obligations — such as the proper care of the horse or the agreed usability of the facility — despite being given a reasonable deadline to remedy the failure.

Part F – Final Provisions

Section 16 Jurisdiction

16.1 If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contractual relationship is MainEquine's registered office, Selters.

16.2 For consumers, the statutory places of jurisdiction apply.

Section 17 Consumer Dispute Resolution

MainEquine is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Consumers may additionally turn to the EU Commission's online dispute resolution platform for the out-of-court settlement of disputes, provided it is available at the time the contract is concluded.

Section 18 Data Protection

Details on the processing of personal data, including photo and video recordings under Section 11, are set out in MainEquine's separate privacy policy and cookie policy.

Section 19 Form of Amendments

Amendments and supplements to the individual contract require text form. This does not apply to individual oral agreements made in a specific case, which are effective independently of this formal requirement and take precedence over these GTC and the written contract (Section 305b BGB).

Section 20 Severability Clause

Should individual provisions of these GTC be or become invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced, to the extent one exists, by the applicable statutory provision.
